DECLARATION

By
filling up the Request Form or by delivering any electronic Hardware
and/or software and/or data on any media/Hardware (collectively,
“e-waste”) to HCL Infosystems Limited or its authorized recyclers
(collectively, “HCL”), you (“You” or the “Customer”) agree to be bound
by all of the following terms and conditions. In case you do not
agree to any of the following terms and conditions, then you must not
fill up the Request Form nor deliver the e-waste to HCL:

You shall not claim
any costs towards the value of e-waste or the costs associated with
delivery / packaging, or any other costs.

Any
e-waste, once delivered cannot be claimed back under any
circumstances. You warrant that you have an absolute authority to
deliver the e-waste for destruction.

You
acknowledge that e-waste once delivered is liable for immediate
destruction without incurring any liabilities whatsoever towards you
or any third party.

You
must properly, adequately and securely pack all e-waste before
delivery to HCL.

HCL
in its absolute discretion reserves the right to accept or reject your
request for e-waste recycling.

In no
event shall HCL be liable to you, whether in contract or tort or under
any other legal or equitable theory (including strict liability) for
any direct, indirect, incidental, exemplary, punitive, special or
consequential damages, including without limitation, loss of data,
programs, intellectual properties, business, profits, revenues, or any
and all other commercial damages or losses, even if HCL had been
advised of the possibility of such damages.

You
agree to indemnify and hold HCL harmless of and from any and all loss,
cost, claim, liability, suit, judgement or expense, including
reasonable attorneys' fees, arising out of breach of your warranty
under Section 1 above or from third party claims.

You
agree that disputes, if any, must be settled in the exclusive
jurisdiction of courts of New Delhi under the laws of India.
